Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the BarTrekker application, website and related services (together, the "Service") and your purchase and use of BarTrekker tickets and events. Please read these Terms carefully before registering for an account, purchasing a ticket or participating in a BarTrekker event. By creating an account, purchasing a ticket or using the Service, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service or purchase a BarTrekker ticket.

1. ABOUT BARTREKKER

1.1

1.2

BarTrekker provides a digital platform that enables customers to discover, purchase and participate in events and experiences involving participating bars, restaurants and other venues. Depending on the event, BarTrekker may provide customers with:

Unless expressly stated otherwise for a particular event, BarTrekker does not itself operate, own, manage or control the participating bars, restaurants or other venues. BarTrekker acts primarily as a platform and organiser/coordinator connecting customers with participating venues.

1.4

The individual services provided at a participating venue, including food, beverages, alcohol, admission, venue facilities and other venue services, remain the responsibility of the relevant venue.

2. Definitions

For the purposes of these Terms:

"BarTrekker", "we", "us" or "our" means BARTREKKER LTD.

"App" means the BarTrekker mobile application and any associated software.

"Customer", "you" or "your" means any person who registers for an account, purchases a ticket or uses the Service.

"Event" means a BarTrekker tour, tasting, experience or other event advertised through the Service.

"Ticket" means a ticket purchased by a Customer for a specific Event.

"Venue" means a bar, restaurant, food establishment or other participating business involved in an Event.

"QR Code" means the digital ticket code issued through the Service for presentation at participating Venues.

"Service" means the App, website, ticketing functionality, notifications, event information and other services supplied by BarTrekker.

3. Eligibility and Age Requirements

3.1

BarTrekker accounts may only be created by persons aged 18 or over.

3.2

Some Events may have additional age requirements. Where an Event involves alcohol, the Event may be restricted to persons aged 18 or over regardless of the general nature of the Event.

3.3

Certain Events, such as food tasting Events, may permit persons under 18 to participate where expressly stated in the Event description. However, tickets may only be purchased through BarTrekker by persons aged 18 or over.

3.4

You are responsible for ensuring that you meet the age and eligibility requirements of the Event you purchase.

Where an Event involves alcohol, participating Venues may require valid photographic identification. The Venue may refuse alcohol service where:

Purchasing a BarTrekker Ticket does not guarantee that you will be served alcohol. BarTrekker does not control the decision of a Venue to provide or refuse alcohol.

4. User Accounts

4.1

An account is required to purchase and use BarTrekker Tickets.

4.2

You must provide accurate and truthful information when creating an account.

4.3

Accounts are associated with an email address. You must not deliberately create accounts for fraudulent, abusive or unlawful purposes.

4.4

You are responsible for keeping your account credentials secure and for activity carried out through your account, except where the relevant activity results from circumstances outside your reasonable control.

4.5

You must notify BarTrekker promptly if you believe your account has been accessed without authorisation.

4.6

BarTrekker may suspend or terminate an account where we reasonably believe that:

5. Purchasing Tickets

5.1

Tickets are purchased through the BarTrekker Service.

5.2

Before completing a purchase, Customers should review the Event description, including:

A Ticket purchase is completed once payment has been successfully authorised and BarTrekker has issued confirmation of the purchase.

5.4

A Customer may purchase multiple Tickets where this functionality is made available. Multiple Tickets may be associated with a single QR Code where stated by BarTrekker.

5.5

A Ticket is valid only for the Event, date and period specified at the time of purchase.

5.6

Tickets expire when the relevant Event has finished. Unused Tickets do not automatically carry forward to another Event.

6. Ticket Transfers and Resale

6.1

Unless BarTrekker expressly permits otherwise, Tickets are personal to the Customer and may not be transferred, sold, resold or commercially distributed.

Customers must not:

Where BarTrekker reasonably believes that a Ticket has been obtained, transferred or used fraudulently, we may cancel the Ticket and/or suspend the associated account.

7. QR Codes and Venue Entry

7.1

Customers may be required to present or scan their QR Code at participating Venues.

7.2

A QR Code may only be used in accordance with the instructions provided by BarTrekker.

7.3

Where multiple Tickets are contained within one QR Code, the Customer presenting the QR Code is responsible for ensuring that all persons using those Tickets are entitled to participate.

7.4

A Venue may require additional information or identification before allowing a Customer to participate.

7.5

A Ticket does not override the lawful admission policies of a Venue.

8. Participating Venues

8.1

Participating Venues are independent businesses and are not employees, agents or branches of BarTrekker unless expressly stated otherwise.

8.2

Each Venue remains responsible for its own:

BarTrekker works with participating Venues to establish the offers, benefits and arrangements applicable to each Event.

8.4

Venues may have legitimate reasons to refuse entry or service to a Customer. This may include circumstances involving:

Purchasing a Ticket does not give a Customer an unconditional right to enter or remain within a Venue.

9. Venue Deals, Discounts and Complimentary Items

9.1

Event benefits vary between Events and Venues. These may include discounts, tastings, complimentary drinks, food samples or other benefits.

9.2

Where alcohol or food is provided by a Venue, the Venue is responsible for providing that item in accordance with applicable law and its own licensing, health and safety requirements.

9.3

BarTrekker does not guarantee that a Customer will consume alcohol or receive a particular alcoholic beverage.

9.4

A Venue may refuse alcohol or another product where it is legally entitled or required to do so.

9.5

The specific benefits applicable to an Event will be communicated through the Event listing or other information supplied by BarTrekker.

10. Venue Changes, Substitutions and Closures

10.1

BarTrekker may need to change the Venue or route forming part of an Event. This may occur because of:

Where reasonably possible, BarTrekker will provide Customers with notice of material Event changes by email or through the App.

Where appropriate, BarTrekker may substitute a Venue with another suitable Venue.

10.4

BarTrekker will seek to ensure that any replacement Venue is reasonably consistent with the nature of the advertised Event, but the precise experience at an individual Venue may vary.

10.5

If a Venue unexpectedly closes or is unable to honour an advertised Event benefit, Customers should contact BarTrekker customer service as soon as reasonably possible.

10.6

Where a Venue failure materially affects the Event, BarTrekker may provide an appropriate partial refund or alternative remedy, taking into account the circumstances and applicable consumer rights.

11. Event Cancellation by BarTrekker

11.1

BarTrekker may cancel an Event where necessary.

11.2

If BarTrekker cancels an Event before it takes place, Customers who purchased valid Tickets for that Event will normally receive a full refund of the Ticket price.

11.3

Refunds will be made using the payment method used for the original purchase where reasonably practicable.

11.4

This section does not affect any statutory rights a Customer may have.

12. Customer Cancellations and Refunds

12.1

BarTrekker permits Customers to request cancellation of a Ticket up to 4 hours before the scheduled start of the relevant Event, subject to the conditions in this section.

12.2

To request a cancellation, the Customer must contact BarTrekker customer service at: +48 451 047 025

Cancellation requests received less than 4 hours before the Event may be refused, except where the Customer has a statutory right to a refund or other remedy.

12.4

Where a Ticket is validly cancelled in accordance with this section, BarTrekker will process the applicable refund.

12.5

Customers who do not attend an Event ("no-shows") are generally not entitled to a refund.

12.6

A Ticket that is not used before the Event finishes expires and does not create an entitlement to a refund.

12.7

Nothing in these Terms removes or restricts any mandatory consumer rights applicable to the Customer under applicable law.

13. Customer Conduct

13.1

Customers must behave responsibly and respectfully when using the Service and participating in Events.

Customers must comply with:

The following behaviour is prohibited:

BarTrekker and participating Venues may take reasonable action where a Customer breaches these requirements. This may include removal from an Event, refusal of entry, cancellation of a Ticket, suspension of an account or termination of access to the Service.

13.5

Where a Ticket is cancelled because of serious misconduct, the Customer will generally not be entitled to a refund, except where applicable law requires otherwise.

14. Alcohol

14.1

Some BarTrekker Events may involve alcohol.

14.2

BarTrekker does not itself supply or serve alcohol unless expressly stated otherwise.

14.3

Alcohol supplied as part of an Event is supplied by the relevant participating Venue.

14.4

The Venue is responsible for complying with applicable licensing and alcohol laws.

14.5

Customers must comply with all Venue rules concerning alcohol.

14.6

Customers must not participate in an Event while behaving in a manner that creates a safety risk to themselves or others.

14.7

BarTrekker does not guarantee that every Customer will receive alcohol.

14.8

A Venue may refuse alcohol service where permitted or required by law or where the Venue reasonably considers refusal appropriate.

15. Personal Safety and Travel Between Venues

15.1

Customers are responsible for their own safety when travelling between Venues.

15.2

BarTrekker may provide directions, route information, notifications or links to external mapping applications.

15.3

Customers must exercise their own judgement when travelling and must comply with local traffic, pedestrian and other safety requirements.

15.4

Customers should not rely exclusively on BarTrekker's directions or notifications when determining whether a route is safe or suitable.

15.5

Customers remain responsible for choosing a safe route and mode of transport.

16. Maps, GPS and Directions

16.1

BarTrekker may provide links or directions that open in third-party mapping applications.

16.2

BarTrekker does not itself provide GPS positioning.

16.3

The accuracy of GPS positioning, walking times, routes, road conditions, maps and directions may depend upon the Customer's device, internet connection, third-party mapping provider and external circumstances.

16.4

BarTrekker does not guarantee that:

Customers are responsible for using reasonable judgement when following directions.

17. App Availability and Maintenance

17.1

BarTrekker aims to keep the Service available but does not guarantee uninterrupted or error-free availability.

17.2

The App may occasionally be unavailable because of:

BarTrekker may temporarily suspend or restrict access to the Service where reasonably necessary.

17.4

Where reasonably practicable, BarTrekker will seek to notify Customers affected by material changes to an Event.

18. Changes to the App and Events

18.1

BarTrekker may modify, improve, update or discontinue features of the Service.

18.2

BarTrekker may change Event routes, Venue arrangements and other Event details where reasonably necessary.

18.3

Where a change materially affects an Event for which a Customer has already purchased a Ticket, BarTrekker will provide notification where reasonably practicable.

18.4

Where a material change substantially affects what the Customer purchased, BarTrekker will provide any remedy required under applicable law and, where appropriate, may provide a refund or alternative arrangement.

19. Third-Party Services

19.1

The Service may interact with or link to third-party services, including mapping applications, payment providers and other external services.

19.2

Third-party services are controlled by their respective providers and may be subject to separate terms and privacy policies.

19.3

BarTrekker is not responsible for the availability, functionality or content of third-party services to the extent that such matters are outside BarTrekker's reasonable control.

19.4

Nothing in this section limits any rights the Customer may have against BarTrekker under applicable law.

20. Payments

20.1

Customers must pay the price displayed for the relevant Ticket at the time of purchase.

20.2

Payment processing may be provided by a third-party payment provider.

20.3

BarTrekker does not ordinarily receive or store complete payment card details where those details are processed directly by the relevant payment provider.

20.4

Customers must not use another person's payment method without proper authorisation.

20.5

BarTrekker may suspend or investigate an account where a payment is suspected to be fraudulent, unauthorised or otherwise unlawful.

21. Chargebacks and Payment Disputes

21.1

Customers should contact BarTrekker before initiating a payment dispute where they believe that a refund is due.

21.2

A Customer must not initiate a fraudulent or knowingly false chargeback.

21.3

Where BarTrekker reasonably believes that a chargeback is fraudulent, abusive or made in bad faith, BarTrekker may investigate the matter and may suspend the associated account while the matter is investigated.

21.4

Nothing in these Terms prevents a Customer from exercising any legitimate statutory right or right available through their payment provider.

22. Intellectual Property

22.1

BarTrekker owns or is authorised to use the intellectual property associated with the Service, including, where applicable:

Publicly available information concerning locations, streets, venues and other geographical information may not be owned by BarTrekker.

22.3

Customers receive a limited, personal, non-exclusive and non-transferable right to use the Service for its intended purpose.

22.4

Customers must not, without BarTrekker's prior written permission:

Nothing in these Terms prevents a Customer from using publicly available information for ordinary personal or informative purposes.

23. Prohibited Use of the Service

Customers must not use the Service to:

24. Suspension and Termination

24.1

BarTrekker may suspend or terminate a Customer's access to the Service where reasonably necessary because of:

Where practicable and appropriate, BarTrekker may notify the Customer of the reason for suspension or termination.

24.3

Termination does not affect rights or obligations that arose before termination.

24.4

Nothing in this section limits mandatory consumer rights.

25. Responsibility for Venue Services

25.1

Participating Venues are responsible for the services and products they independently provide.

25.2

This includes responsibility for:

BarTrekker will take reasonable steps to coordinate Events with participating Venues but does not control the day-to-day operation of those businesses.

25.4

Where a Customer has a complaint concerning a specific product or service supplied directly by a Venue, BarTrekker may assist in communicating the complaint to the Venue, but the Customer's rights against the Venue are not replaced by these Terms.

26. Limitation of Liability

26.1

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that applicable law does not permit BarTrekker to exclude or limit.

26.2

Subject to clause 26.1 and applicable consumer law, BarTrekker is responsible only for losses that are reasonably foreseeable consequences of BarTrekker's breach of its obligations or negligence.

26.3

BarTrekker is not responsible for losses caused by matters outside BarTrekker's reasonable control, including failures of third-party services, mapping providers, telecommunications networks or independently operated Venues, except where applicable law provides otherwise.

26.4

BarTrekker is not responsible for a Customer's failure to:

Nothing in this section removes or reduces the Customer's statutory consumer rights.

27. Customer Responsibility for Damage or Loss

27.1

A Customer may be responsible for losses or damage caused by the Customer's unlawful, deliberate or negligent conduct.

27.2

This may include damage caused to participating Venue property.

27.3

BarTrekker does not automatically accept responsibility for claims made by Venues against Customers.

28. Events Outside BarTrekker's Control

28.1

BarTrekker will not be responsible for failure or delay caused by circumstances outside its reasonable control. These may include:

Where such circumstances affect an Event, BarTrekker will take reasonable steps to notify affected Customers and, where appropriate, offer an alternative arrangement or refund in accordance with applicable law.

29. Privacy

29.1

BarTrekker processes personal data in accordance with its Privacy Policy.

29.2

The Privacy Policy explains what information BarTrekker collects, why it is collected, how it is used and the rights available to Customers.

29.3

The Privacy Policy forms part of the information provided to Customers but does not replace these Terms.

30. Changes to These Terms

30.1

BarTrekker may update these Terms from time to time.

30.2

Where a change materially affects Customers who have already purchased a Ticket, BarTrekker will not use the change to retrospectively remove rights that have already been acquired, except where necessary to comply with law or where otherwise permitted by the original agreement.

30.3

For material changes affecting existing Customers, BarTrekker will provide reasonable notice where practicable.

30.4

The version of the Terms applicable to a Ticket purchase will generally be the version accepted at the time of purchase, subject to mandatory legal requirements and any later changes that the Customer validly accepts.

31. Governing Law and Jurisdiction

31.1

These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws of the country in which the Customer resides provide otherwise.

31.2

Nothing in these Terms prevents a consumer from relying on mandatory consumer protections available under the laws that apply to their transaction.

31.3

Where a dispute cannot be resolved directly between the Customer and BarTrekker, the parties may use any applicable alternative dispute resolution or court procedures available under applicable law.

32. Consumer Rights

32.1

Nothing in these Terms is intended to remove, restrict or exclude any consumer right that cannot legally be excluded.

32.2

Where applicable law gives a Customer rights relating to the quality, performance, conformity or provision of the Service, those rights remain unaffected.

32.3

Where applicable, Customers may have statutory rights relating to cancellation, refunds, defective or improperly performed services and other consumer protections.

32.4

Where a statutory right conflicts with these Terms, the statutory right will prevail to the extent required by law.

33. Complaints

33.1

Customers should first contact BarTrekker if they have a complaint concerning an Event or the Service.

Complaints may be submitted using:

BarTrekker will consider complaints reasonably and in accordance with applicable law.

34. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it lawful and enforceable where legally possible. If this is not possible, the relevant provision will be removed without affecting the validity of the remaining provisions.

35. No Waiver

A failure or delay by BarTrekker in enforcing any provision of these Terms does not constitute a waiver of BarTrekker's right to enforce that provision in the future.

36. Entire Agreement

These Terms, together with the applicable Event information, purchase information and BarTrekker Privacy Policy, form the agreement between BarTrekker and the Customer concerning the use of the Service and purchase of the relevant Ticket, subject to any mandatory rights imposed by applicable law.
